Mistake costs dishwasher $59,000

MIAMI, Florida (CNN) -- For 11 years, Pedro Zapeta, an illegal immigrant from Guatemala, lived his version of the American dream in Stuart, Florida: washing dishes and living frugally to bring money back to his home country.

But when Zapeta tried to go through airport security, an officer spotted the money in the bag and called U.S. customs officials.

"They asked me how much money I had," Zapeta recalled, speaking to CNN in Spanish.

He told the customs officials $59,000. At that point, U.S. customs seized his money, setting off a two-year struggle for Zapeta to get it back.

Zapeta, who speaks no English, said he didn't know he was running afoul of U.S. law by failing to declare he was carrying more than $10,000 with him. Anyone entering or leaving the country with more than $10,000 has to fill out a one-page form declaring the money to U.S. customs.

Officials initially accused Zapeta of being a courier for the drug trade, but they dropped the allegation once he produced pay stubs from restaurants where he had worked. Zapeta earned $5.50 an hour at most of the places where he washed dishes. When he learned to do more, he got a 25-cent raise.

After customs officials seized the money, they turned Zapeta over to the Immigration and Naturalization Service. The INS released him but began deportation proceedings. For two years, Zapeta has had two attorneys working pro bono: one on his immigration case, the other trying to get his money back.

"They are treating me like a criminal when all I am is a working man," he said.

Zapeta's story became public last year on CNN and in The Palm Beach Post newspaper, prompting well-wishers to give him nearly $10,000 -- money that now sits in a trust.

Robert Gershman, one of Zapeta's attorneys, said federal prosecutors later offered his client a deal: He could take $10,000 of the original cash seized, plus $9,000 in donations as long as he didn't talk publicly and left the country immediately.

Zapeta said, "No." He wanted all his money. He'd earned it, he said.

Now, according to Gershman, the Internal Revenue Service wants access to the donated cash to cover taxes on the donations and on the money Zapeta made as a dishwasher. Zapeta admits he never paid taxes.

CNN contacted the U.S. Attorneys office in Miami, U.S. Customs and the IRS about Zapeta's case. They all declined to comment. Marisol Zequeira, an immigration lawyer, said illegal immigrants such as Zapeta have few options when dealing with the U.S. government.

"When you are poor, uneducated and illegal, your avenues are cut," he said.

On Wednesday, Zapeta went to immigration court and got more bad news. The judge gave the dishwasher until the end of January to leave the country on his own. He's unlikely to see a penny of his money.

"I am desperate," Zapeta said. "I no longer feel good about this country."

Zapeta said his goal in coming to the United States was to make enough money to buy land in his mountain village and build a home for his mother and sisters. He sent no money back to Guatemala over the years, he said, and planned to bring it all home at once.

At Wednesday's hearing, Zapeta was given official status in the United States -- voluntary departure -- and a signed order from a judge. For the first time, he can work legally in the U.S.

By the end of January, Zapeta may be able to earn enough money to pay for a one-way ticket home so the U.S. government, which seized his $59,000, doesn't have to do so.

I felt bad for him until I read that, ooh bad move. Uncle Sam just wants his cut. Seriously, though they should take the 11 years back taxes (minus Social Security) from his $59,000 and give him the rest so he can go home. He did earn it, and I KNOW I'd be pissed if somebody took away the money that I actually worked my ass off for.

I know that I would be seriously pissed off if the Gov't seized my money, legal or not. One man got the book thrown at him, because he did not know of our rules about money. Damn, here take $10,000 and leave the country. Shit, they could care less. Should have sent it Western Union, Fed Ex, UPS, etc. Not like its going to blow up or something.

Totally agree with you on this point . Besides, How much does he REALLY owe on five freakin dollars an hour anyway?

he probably already had the taxes taken out. just used a "friends" social security number. probably even had to pay to use it.

That's a pretty broad statement, and it would depend on the circumstance. If you're a drug dealer than yeah, you're fucked because you sold an illegal substance and the money is also evidence. Generally, courts must order seized property returned to its owner at the final disposition of the criminal action or as soon thereafter as practical. If there is no criminal action, the court must issue its order within six months after a claim for the property’s return is made. Stuff such as illegal drugs and fireworks/firearms are forfeited and destroyed. The worst thing this guy did was illegally immigrate to the US and not pay taxes. The most he should get is fine, max some jail time (if that) and that's actual US law. Hell, considering you even get your cash bond/bail returned to you once your criminal trial is over; he should still be entitled to monies he earned working while washing dishes.

He was already doing the USA the favor by paying for his own way back to his country verses all this money now being spent for legal proceedings, bullshit red tape and forms. Fine he broke the law charge him, fine his ass (because that's where it'll hurt him the most), give back what's left of his $$$ and let him be on his way...

Motherfucker was working minimum wage busting his ass doing manual labor that nobody is trying to make a career of. I can't see how he could get away w/ not paying taxes considering he has pay stubs, unless he was a contractor (who who individually contracts dishwashers at min wage?) state, fed & SS were taken out automatically. Unless he claimed 5 dependents on his W-2 or something. Dude barely speaks english, he doesn't understand the tax laws. He probably admitted all kinds of shit he doesn't know shit about.

Either way, take another round of 0 dependents declared taxes out of those checks... whatever. But give the rest back. I can't believe some of you out there believe a man can do some honest manual labor and not get paid for it. Seriously, that shit is like breathing air, drinking water and shitting... it's been part of civilization from the beginning of our existence.

I doubt he had pay stubs. He probably got paid in cash under the table or with a personal check from the owner/manager. I had a job where I got paid by personal check before (no pay stub), but at least they did the math and took the taxes out.

Hmm, I saw another article that said he produced pay stubs to prove he earned that money, which is why they no longer think he's a drug mule. But, if the employer was paying him under the table, the employer owes back taxes too.
